From other replies it seems as if "assuming arms" is simply the act of creating and using arms without officially petitioning them to the herald. So if I am in Scotland, does that mean I could actually be fined for just designing arms, or only from displaying / using it?

Some of us may desire to assume arms (e.g. for their aesthetics), but be hesitant to do so for fear that arms may be considered pretentious, or that they may be too old-fashioned. I don't know why that comment was written, but it clearly describes something real (even if it was sarcastic, which I'm not sure of).
